Privacy Notice on the Processing of Personal Data

As Argeset Yazılım Danışmanlık San. ve Tic. Ltd. Şti. (“Argeset” or the “Company”), in our capacity as data controller under Law No. 6698 on the Protection of Personal Data (“KVKK”), we process your personal data within the scope described below. This notice has been prepared in accordance with Article 10 of the KVKK and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform.

Categories of personal data processed
- Identity: first name, last name, title.
- Contact: email address, telephone number, address, company information.
- Customer transactions: records of requests, quotes, orders, support and complaints, and the content of form messages.
- Marketing: commercial electronic message preferences (only if you give your consent).
- Transaction security: an irreversible hash of the IP address, browser type, access time and security logs.
- Usage data: anonymous statistics such as pages visited, referring site and device type; analytics and marketing cookies only with your consent.
Purposes of processing
- Receiving, assessing and responding to your requests, questions and complaints,
- Conducting demo, quotation and sales processes; entering into and performing contracts,
- Providing support, training and after-sales services for our products and services,
- Ensuring the security of the website and preventing misuse and spam submissions,
- Measuring service quality and improving the website (anonymous statistics),
- Sending commercial electronic messages about our products, events and campaigns, if you give your consent,
- Fulfilling legal obligations and responding to requests from competent authorities.
Method of collection and legal grounds
Your personal data is collected through the forms on our website, email, telephone, meetings and contractual processes, by partly or fully automated means. Your data is processed on the basis of the following legal grounds set out in Article 5 of the KVKK:
- processing is directly related to the conclusion or performance of a contract (Article 5(2)(c)),
- processing is necessary for the data controller to comply with its legal obligations (Article 5(2)(ç)),
- processing is necessary for the establishment, exercise or protection of a right (Article 5(2)(e)),
- processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject (Article 5(2)(f)),
- your explicit consent with regard to sending commercial electronic messages and to analytics and marketing cookies (Article 5(1)).
Transfer of personal data
Limited to the purposes above, your personal data may be transferred, in accordance with Article 8 of the KVKK, to the hosting, email and information technology suppliers we use, to our business partners, to the persons from whom we receive legal and financial advisory services and, upon request, to competent public institutions and organisations.
If you consent to analytics or marketing cookies, your data may be transferred abroad because the servers of the relevant service providers (e.g. Google, Meta, LinkedIn, Microsoft) are located outside Türkiye. Transfers abroad are carried out in accordance with the conditions set out in Article 9 of the KVKK (an adequacy decision, appropriate safeguards such as standard contracts, or your explicit consent in the case of incidental transfers).
Retention periods
- Contact and demo form records: 2 years,
- KVKK data subject requests: 10 years, taking statutory limitation periods into account,
- Contracts and commercial records: the periods required by the relevant legislation (e.g. 10 years under the Turkish Commercial Code and the Tax Procedure Law),
- Security logs: the periods required by Law No. 5651 and related legislation.
Data whose retention period has expired is automatically deleted from our systems in accordance with the Regulation on the Erasure, Destruction or Anonymisation of Personal Data.
Your rights under Article 11 of the KVKK
Under Article 11 of the KVKK, you have the right:
- to learn whether your personal data is being processed,
- to request information about the processing if your personal data has been processed,
- to learn the purpose of processing your personal data and whether it is used in line with that purpose,
- to know the third parties, in Türkiye or abroad, to whom your personal data is transferred,
- to request the rectification of your personal data if it has been processed incompletely or inaccurately, and to request that this be notified to the third parties to whom your personal data has been transferred,
- to request the erasure or destruction of your personal data where the reasons requiring its processing no longer exist, even though it has been processed in accordance with the KVKK and other applicable laws, and to request that this be notified to the third parties to whom your personal data has been transferred,
- to object to any outcome to your detriment arising from the analysis of the processed data exclusively by automated systems,
- to claim compensation for damages if you suffer loss as a result of the unlawful processing of your personal data.
How to apply
To exercise the rights listed above, you may submit your request, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, by one of the following methods:
- via the Data Subject Request Form on our website,
- by a petition bearing your wet signature, together with documents proving your identity, delivered in person or through a notary public to Fetih Mah. Tahralı Sk. Kavakyeli İş Merkezi B Blok Kat:3 Daire:7, Ataşehir / İstanbul,
- by sending an email to info@argeset.com using a secure electronic signature, a mobile signature or the email address you have previously notified to us and which is registered in our systems,
- via your registered electronic mail (KEP) address.
Your application must include your full name, Turkish ID number (for foreign nationals, nationality and passport number), residential or business address for notification purposes, email address for notification (if any), telephone number and the subject of your request. Your request will be concluded free of charge as soon as possible according to its nature and within thirty days at the latest. If the process requires an additional cost, a fee may be charged in accordance with the tariff set by the Personal Data Protection Board (KVKK Board).
